When the issue of establishing a guardianship arises, it can be an emotionally charged legal struggle amongst family members. At the Orlando offices of Frank G. Representing Individuals and Families in Guardianship Matters

Elderly individuals are often the subject of a guardianship proceeding. The alleged incapacitated person will be examined by a three member committee, appointed by the court and consisting of medical professionals with education and expertise in the area of the alleged incapacity. The committee usually has a psychologist or a psychiatrist, and other doctors or nurses with specialized knowledge that will assist the court in making a determination of incapacity.

The court will also appoint an attorney to represent and protect the interests of the alleged incapacitated person. In addition to working for the party initiating the guardianship proceeding, we also represent the individual who is the subject of the guardianship and work to protect their rights.

In many cases, a guardianship of an adult must be created to ensure their safety and security. Adults who are incapable of caring for themselves due to drug addiction, physical incapacitation, mental illness, mental retardation, or other reasons may require the intervention of a loved one or friend to ensure their well being.
