Experienced Counsel in Estate, Probate and Guardianship Matters

If you have decided that you need to establish a plan for the distribution of your assets and/or the care of your minor children in the event of your death, you want an experienced attorney who is familiar with the many ways of passing your property to others. You want a lawyer who understands the tax implications of the different strategies, as well as whether you will be able to circumvent the probate process. Likewise, if you have been named as executor, administrator or personal representative of the estate of a loved one, you want guidance from an attorney who knows and understands the probate process.

At the law offices of Frank G. Finkbeiner Attorney at Law, in Orlando, we work closely with individuals and families who either need to plan for the distribution of an estate or need to take the estate of a loved one through the probate process. Estate Planning

When you hire us to assist you with your estate planning, we begin by gathering as much information as we can about you--your goals, your assets and obligations and any special needs you have. Then we fully explain the different estate planning strategies and the advantages and disadvantages of each, including the use of dispositional documents such as wills and trusts, the re-titling of assets to avoid probate, and the implementation of lifetime gifting. Once you have selected a strategy, we will prepare and execute all the documents required to establish your estate plan, including

  • Wills
  • Living and testamentary trusts
  • Revocable and irrevocable trusts
  • Charitable trusts
  • Special needs trusts
  • Powers of attorney
  • Living wills and health care surrogacy documents

Probate Administration

If you have been named as the executor, administrator or personal representative of the estate of a loved one, you may be uncertain as to what your responsibilities are for settling the estate through the probate court. We will handle all aspects of the probate process, from the preparation of an inventory of assets to the payment of all debts and taxes of the estate to the distribution of assets according to the decedent's wishes. We will make certain that any claims to the estate are legitimate and that the process is carried out in a timely manner. This entails filing all required documents with the probate court and appearing on your behalf at all hearings or proceedings. We will also collect all required information in order to prepare and file an Estate Tax (706) return where required.

Guardianships

If you have a family member who is either incompetent or is underage without a parent, we can help you establish a guardianship, whereby the court will appoint a responsible adult to act in the best interests of that person, known as the ward. We will counsel with all potential applicants file any necessary papers, seek and obtain the appointment of a guardian and advise the guardian regarding how to protect the interests of the ward. We will also handle any annual filings and make certain the guardian complies with all legal requirements.
